The Apple TV+ series The Morning Show producers lost $44 million over their lawsuit against the company’s insurance company, Chubb National Insurance after the judge dismissed the case with prejudice. Due to the judge’s decision, the suit can not be refiled.

In the case, the producers of The Morning Show alleged that the Apple TV+ insurance company refused to pay coverage of losses from production issues caused by COVID-19 during the filming of season 2. U.S. District Judge Fernando M. Olguin wrote they had “failed to allege any physical loss or damage to property.” He also wrote, “no benefits were due under the Policy’s Imminent Peril and Ingress and Egress provisions.”

Michael Ellenberg, executive producer of The Morning Show for Apple TV+, filed the lawsuit last year in July on behalf of his company Media Res. Media Res, Always Smiling Productions, and the EP claimed a secured $125 million in cast coverage from Chubb. More was claimed for imminent peril for the filming location. The claim is that Chubb owes the money over the delays in the production of the second season of the Reese Witherspoon and Jennifer Aniston series.

Chubb paid $1 million in losses for Civil Authority or Military provision. Regarding COVID-19, the delay was not covered as it was not any of the listed requirements for coverage: “death, injury, sickness, kidnap, or compulsion by physical force or threat of physical force.”

The Morning Show is in production for season 3 to make its return to Apple TV+. The next season will be helmed by showrunner and executive producer Charlotte Stoudt (House of Cards). She currently holds a multi-year deal with the company for scripted TV series. Newcomers to the series for the third outing will include Jon Hamm and Tig Notaro (Army of the Dead). Its first two seasons are currently available on the streaming service.
